PROGRAM OVERVIEW

What Is Spousal Sponsorship?

Spousal and partner sponsorship is part of Canada’s family reunification program. An eligible Canadian citizen, permanent resident or person registered in Canada under the Indian Act may sponsor an eligible spouse or partner to become a permanent resident.

The sponsor and person being sponsored submit related applications together: the sponsorship application and the permanent residence application. The principal applicant submits the package online through the Permanent Residence Portal.

UNDERTAKING 3 Years Financial responsibility for a sponsored spouse or partner.
INCOME RULE Usually No MNI Most spouse or partner cases do not require a minimum income threshold.

OPTION 01

Spouse or Partner in Canada

A spouse or common-law partner living with the sponsor in Canada may be able to apply under the Spouse or Common-Law Partner in Canada Class.

  • Typically used when the couple is living together in Canada.

  • Temporary resident status and work-permit rules still matter.
  • Applicants should carefully consider travel while the case is processing.

Who Can Sponsor and Who Can Be Sponsored?

Who Can Sponsor?

  • At least 18 years old.
  • Canadian citizen, permanent resident, or person registered under the Indian Act.
  • Generally living in Canada.
  • Canadian citizens abroad must show plans to return to Canada when the sponsored person becomes a permanent resident.
  • Permanent residents living outside Canada cannot sponsor.
  • Must sign the sponsorship undertaking and agreement.

Spouse

  • Legally married to the sponsor.
  • At least 18 years old.
  • Relationship must be genuine.
  • Must not be inadmissible to Canada.

Common-Law Partner

  • Not legally married to the sponsor.
  • At least 18 years old.
  • Must have lived together for at least 12 consecutive months in a conjugal relationship.
  • Relationship must be genuine.

Conjugal Partner

  • At least 18 years old.
  • Lives outside Canada.
  • Exclusive and mutually interdependent relationship for at least 1 year.
  • Unable to marry or live together because of significant legal, immigration, social, cultural or similar barriers.
You may not be eligible to sponsor in some situations.

Examples can include certain previous sponsorship obligations, receiving social assistance for reasons other than disability, unresolved support-payment obligations, an undischarged bankruptcy, some criminal convictions, or being subject to a removal order.

DOCUMENT CHECKLIST

Prepare Evidence That Tells the Full Story

Your exact checklist depends on your relationship, country of residence, immigration history and family composition. Documents should be consistent and support both eligibility and the genuineness of the relationship.

Identity & Civil Status Passports, birth certificates, marriage records, divorce records or other civil-status documents.
Relationship Evidence Photos, communication history, travel, shared activities and evidence showing a genuine relationship.
Proof of Cohabitation Joint lease, shared bills, financial records, correspondence and other proof where common-law status applies.
Sponsor Documents Proof of Canadian citizenship, permanent residence or other qualifying sponsor status.
Police Certificates Required police clearances based on the applicant’s residence history and IRCC instructions.
Medical & Biometrics IRCC may request medical examinations and biometrics after the application enters processing.
APPLICATION PROCESS

From Sponsorship to Permanent Residence

    The principal applicant submits the sponsorship and permanent residence applications together through the PR Portal.

    Receive AOR & Requests

    If the application is complete, IRCC issues an acknowledgement of receipt and may request biometrics, medicals or additional evidence.

    IRCC assesses sponsor eligibility, relationship genuineness, permanent residence eligibility and admissibility.

    Permanent Residence Decision

OPEN WORK PERMIT

Working in Canada While Your Application Is Processing

Eligible spouses and partners living in Canada who are being sponsored for permanent residence may be able to apply for an open work permit. In many cases, an acknowledgement of receipt is required, along with valid or maintained temporary resident status.

Spousal Sponsorship Questions

Do I need a minimum income to sponsor my spouse or partner?

In most spouse or partner sponsorship cases, there is no minimum necessary income requirement. An income requirement can apply in specific cases involving dependent children who themselves have dependent children.

How long am I financially responsible for my spouse or partner?

For provinces outside Quebec, the sponsorship undertaking for a spouse, common-law partner or conjugal partner is generally three years beginning when the sponsored person becomes a permanent resident.

What counts as a common-law relationship?

IRCC generally considers partners common-law when they have lived together continuously in a conjugal relationship for at least 12 consecutive months, apart from short temporary absences.

Can my spouse work in Canada while the sponsorship is processing?

Eligible sponsored spouses or partners living in Canada may be able to apply for an open work permit. The exact requirements depend on the applicant’s status and stage of processing.

Can a Canadian citizen sponsor while living outside Canada?

A Canadian citizen living outside Canada may sponsor if they can show that they plan to live in Canada when the sponsored person becomes a permanent resident. A permanent resident living outside Canada cannot sponsor.
